How to start a claim for School Accident Compensation
Unfortunately, accidents in nurseries, schools, colleges and universities are fairly common and at Thompsons Solicitors, we are approached by parents whose children have been injured, students themselves who have suffered injuries, teachers who have been injured as well as other visitors to the school premises such as parents or delivery drivers who have suffered injuries.
If you or your child is injured at school and the accident was someone else's fault, you may be able to make a claim for compensation.
Some of the most common types of claims we deal with relating to accident at schools include cases where people have:
We also receive a lot of enquiries from people who have been assaulted or attacked whilst at school; however we can only deal with compensation claims for this type of incident in certain circumstances. Feel free to contact us with details of your specific case and we can let you know if it is something we can help you with.
You can reach us on 08000 224 224 or by completing one of our online compensation claim forms.
If you or your child has an accident and suffers a personal injury whilst at school, which was not their fault, then you may be entitled to make a personal injury compensation claim.
For example, a personal injury compensation claim may be possible if a person trips or slips on a footpath within the school, which has not been properly maintained, leaving it in a dangerous condition. It would also be possible to make a personal injury compensation claim someone was injured by a defective piece of equipment in the school such as a broken chair which collapses or a sharp-edged desk which cut into someone. There should always be sufficient staff on duty to properly supervise and control the activities of the children or students.
If you are in doubt about whether or not you are entitled to claim compensation you can always contact Thompsons Solicitors for free legal advice. Once we take a few details from you about what has happened, we can let you know if it is something we think we can help you with. You can reach us on 0800 7830266 or by completing one of our online compensation claim forms.
To make a successful personal injury compensation claim, you would need to prove that another person was responsible for your personal injury (in this case, the college, nursery, school or university where the accident happened).
To help your case, you should report the accident to a teacher or another person of authority at the time, make a note of your accident in the accident book, take names and addresses of witnesses to the accident and if possible take photographs of the area where the accident happened. In cases involving defective pavements, we would recommend that you take your photographs with a ruler shown in them to show how deep / high the defect was.
If you are intending to claim expenses such as prescription costs and travelling expenses, remember to keep receipts as evidence.
