What are Damages?

Introduction to Personal Injury Damages

When referring to a personal injury claim, the word 'damages' means the same as the word 'compensation'.

What can I claim Personal Injury Damages for?

A claim for personal injury damages can arise from all sorts of different circumstances including a car accident, an accident at work or even clinical negligence.  Claims for damages can also be for illnesses and diseases as well as for injuries.

You can obviously claim damages for the pain and suffering you have sustained as a result of your accident or illness and medical evidence will be used to support this part of your personal injury claim. Notes may be gathered from your own medical records and it may also be necessary for you to visit a private medical specialist.

You will also be entitled to claim damages for lost earnings and this includes any future earnings if your injury is serious enough to prevent you working later in life. Likely future promotions and pensions will also be taken into account.

You will be entitled to claim damages for any expenses which are necessary to aid your recovery such as medication costs, nursing care and rehabilitation costs. You will also be entitled to claim damages for modifications to your house or car if these are necessary to your condition.

In cases involving injured Public Service Workers, who cannot return to work, such as police officers, nurses or fire-fighters, additional damages may be awarded for loss of congenial employment. This is awarded on the basis that their employment was “more than just a job” to them.

In cases involving a fatality, additional damages will be awarded for funeral expenses and compensation will be awarded to any living relatives, such as spouses or children, who were dependent on the deceased for their income and time.
