When you first hear about someone tripping or slipping on a pavement you may be forgiven for imagining cuts, bruises and no serious injuries.  Thankfully this is true in the majority of cases where someone slips or trips on a pavement; however, occasionally people do suffer much more serious injuries.

Unfortunately, some slips and trips on pavements can cause sprains, broken bones, deep lacerations, concussion and worse.  Some unfortunate victims of a slip or trip on a pavement need corrective surgery and are left with permanent scars or pain from their injury.

Am I entitled to make a Compensation Claim after my Pavement Accident?

Types of Pavement Accident Claims we can deal with

If you have an accident and suffer a personal injury whilst on a public pavement, you may be entitled to make a pavement accident compensation claim.

For example if the accident was caused by a pothole at least an inch deep in the concrete or tarmac, you could hold the local authority (or whoever is responsible for maintaining the pavement) responsible. You could also hold them responsible if a paving stone was sticking up above the rest of the path by more than an inch and this caused your accident.

If the defect in the pavement is less than an inch we would not normally suggest trying to make a claim for compensation as it will probably be found that the defect was not of sufficient danger to warrant repair.

What should I do after being involved in a Pavement Accident?

Action to take following a Pavement Accident

To make a successful personal injury compensation claim, you would need to prove that another person was responsible for your personal injury (in this case, the council, local authority or person / company responsible for maintaining the pavement).

To help your case, you should report the accident to the council / local authority or the person / company responsible for maintaining the pavement, make a note of your accident in an accident book if possible, take names and addresses of witnesses to the accident and if possible take photographs of the area where the accident happened. In cases involving defective pavements, we would recommend that you take your photographs with a ruler shown in them to show how deep / high the defect was.

If you are intending to claim expenses such as prescription costs and travelling expenses, remember to keep receipts as evidence.
