Military Personnel – Personal Injury Compensation Claims for Road Traffic Accidents

Am I entitled to make a Personal Injury Compensation Claim for a Road Traffic Accident?

If you are a member of one of the armed forces (army, royal navy or royal air force) and you have a road accident whilst in the UK which injures you, you can make a personal injury claim for compensation against the person responsible for the accident in the same way as any other member of the public. It makes no difference whether the person responsible for the accident is a civilian or another member of the armed forces (for example a colleague driving you around base).

If your road traffic accident happened whilst abroad on duty and the person responsible for your injury was another member of the armed forces then it will still be very simple for you to make a claim for compensation and a personal injury lawyer in the UK such as Thompsons will be able to help you. If; however, the accident happened while you were abroad and was caused by a member of the public, you would need to consult a personal injury solicitor practising in the country where the accident happened.

Armed Forces Compensation Scheme

One other exception for members of the armed forces involved in road traffic accidents is that they cannot claim through the courts for a personal injury they have sustained, which was caused as a direct result of an ongoing conflict they are dealing with. Therefore, if your car accident was directly related to a conflict taking place you might not be able to claim for your injury in the normal way. You may; however, be able to make a personal injury compensation claim via the no fault Armed Forces Compensation Scheme if your accident occurred after 6th April 2005.
