Introduction to Multi Party Military Injury Compensation Claims

If you are unfortunate enough to suffer an accident or injury during your time serving in the military, you may be able make a personal injury claim for compensation.

It is; therefore, very important to seek legal advice as soon as you realise that you have been harmed by the negligence of another party. How Multi Party Military Injury claims progress

As with all personal injury compensation claims, you would need to prove that your injury or illness was caused as a result of the negligence of another party (in this case the Ministry of Defence or fellow service personnel) and once you appoint a personal injury compensation solicitor, they will assist you in compiling your evidence and presenting it to the Ministry of Defence's insurers.

Every personal injury compensation claim is very different and while some are settled within a matter of months, others can take years. Most cases are settled out of Court; however, some will need to progress this far.

Advice specific to Military Personnel injured at work

War Pension and Armed Forces Compensation Claim

If your original accident occurred after 6th April 2005, you may also be entitled to make a personal injury compensation claim via the no fault Armed Forces Compensation Scheme. If your accident was before 6th April 2005, you may also be entitled to make a compensation claim for a War Pension payment.  Whilst eligibility to claim under the War Pension system only comes into effect upon discharge, claims under the Armed Forces Compensation scheme can be made during service and therefore you should not wait until you leave the Armed Forces to start your claim, you should act immediately. Under the Armed Forces Compensation Scheme there is a 5 year time limit so it is important to act quickly as soon as an accident happens.
