Whilst hysterectomy procedures have become safer and easier to perform, there are still risks associated with them, which can often give rise to a successful claim.
The most common risks are of injury to the bladder and bowel and your doctor should advise you of these risks before you agree to the procedure.
Accordingly, in most cases, it is not negligent to accidentally make a hole in the bladder or the bowel, particularly where there are adhesions from previous abdominal procedures. As long as the surgeon recognises that a hole has been made and stitches it up carefully, there is little prospect of bringing a successful claim.
The successful claims arise where there has been a failure to recognise the accidental damage, which if left untreated, can lead to leakage of urine because a vesico vaginal fistula, (a communication between the bladder and the vagina), has developed.
The usual case is where there is leakage of urine, despite the fact that a catheter is in situ. This should result in an immediate diagnosis and will usually result further surgery to repair the fistula.
The claim for compensation will include the pain and suffering caused by the distressing and usually socially embarrassing leakage of urine, and the need to have further surgery.
The other risk is of injury to the bowel, which is a recognised risk, but if left untreated, can lead to very serious consequences caused by the leaking of faecal matter into the abdominal cavity.
This usually results in peritonitis and sepsis, and therefore it is extremely important for the diagnosis of untreated bowel injury to be made quickly to limit the extent of damage. Often it can result in patients losing some of their bowel and having to live with a colostomy bag. This is not only unpleasant, but also socially unacceptable for many.
