Failure of Contraceptive implant, Implanon
It has recently been reported that nearly 600 women have become pregnant despite using the contraceptive device Implanon. Thompsons Solicitors have acted and are acting for women who have become pregnant whilst Implanon was apparently inserted.
This device is designed to stop pregnancies and whilst no contraceptive device can be 100% effective, it would appear that this particular device has led to the NHS having to pay out compensation to many women who have become pregnant when they did not wish to do so. The implant is a small plastic rod which releases hormones into the bloodstream and is inserted under the skin of a woman’s arm by a nurse or doctor.
In 2008 Thompsons acted for Sarah Moss who was 22, who obtained compensation after she became pregnant having had Implanon inserted at Haydock Family Planning Centre. In a recent statement, manufacturers of Implanon, MSD said: “The basis for successful use of Implanon is a correct and carefully performed subdermal insertion of the implant in accordance with the product instructions. If the implant is not inserted in accordance with the instructions on the correct day, this may well result in an unintended pregnancy. In addition, no contraceptive is 100% effective.”
Last year Implanon was replaced with a device that is designed to be inserted more easily.
It is likely that the true level of women who have fallen pregnant whilst using this device is significantly higher than the already reported number of almost 600. As a result of falling pregnant when not wishing to it has resulted in women suffering from psychological difficulties as a result of falling pregnant and either having to make the difficult decision to terminate or having to bring up a child that ideally they may not have desired.
