Types of Medical Misdiagnosis

Medically Misdiagnosed or Undiagnosed

There are 2 main types of medical misdiagnosis.  The first is where a condition is completely undiagnosed, for example a patient visiting their GP with health problems over a period of time and the GP fails to diagnose the illness.  The second is where an incorrect diagnosis is made, for example a fracture being diagnosed as a sprain or a person being told they have cancer when in fact they don't.

When can I make a claim for Medical Misdiagnosis?

Is a claim for medical misdiagnosis possible?

To make a compensation claim for medical misdiagnosis, the treatment you received (or lack of it) has to have caused you further injury, pain or suffering.  For example if you suffered a fall and attended hospital where you were x-rayed and told that you had no broken bones, but then you were contacted the following day by the hospital to advise that they had looked at your x-rays again and discovered a fracture you could only make a claim if the delay in diagnosis had made the fracture worse.

Misdiagnosis of Cancer lead to healthy kidney being removed

Undiagnosed and Untreated Perforated Bowel

Mrs Eastaff had been suffering from abdominal pain and was sent for a CT scan.  The radiologist misread the results of the scan and reported that it was normal when in fact it showed that Mrs Eastaff had a perforated bowel.

Tragically Mrs Eastaff died as a result of her condition and with help from Thompsons Solicitors' clinical negligence team her husband made a medical misdiagnosis claim on her behalf.

Misdiagnosis of infection led to woman being paralysed

Thompsons' specialist clinical negligence solicitors helped a woman make a claim for £900,000 misdiagnosis compensation after a hospital failed to diagnose an infection in her spine.

If the infection had been diagnosed and antibiotics were provided she would probably have made a full recovery; however, as a result of this misdiagnosis she is now paralysed.  She is confined to a wheelchair, has had to have her home adapted and requires assistance with day-to-day activities.

Undiagnosed Fracture

We helped a delivery driver who fell from the back of a lorry and sustained a serious injury to his wrist. The hospital said it was a sprain but in fact there was a fracture and by the time the fracture was diagnosed it was too late to operate effectively (clinical negligence). The driver was paid compensation for the loss of full use of his hand. Although the compensation helped, his life was never the same again as before the accident.
