Multi-Party Personal Injury Compensation for Toxic Torts and Environmental Health Claims

What are Toxic Torts?

Due to the fact that we are now living in an age where dangerous chemicals and radioactive products are commonplace, accidents do occasionally happen and people can be injured as a result.

If a person is unfortunate enough to be injured as a result of an accident like this, they may be entitled to make a personal injury compensation claim for the pain and suffering they have endured as a result.  They may also be entitled to loss of earnings, loss of congenial employment which is the pleasure that some people get from doing the job or compensation for being no longer able to work in certain industries where similar exposures could induce further harm.

The terms used to describe personal injury compensation claims made in this area are “Environmental Health Claims” or “Toxic Torts”. Personal injury compensation claims made in the past have involved instances in which industrial waste has been pumped into the sea, rivers, land sites or the air. Personal injury compensation claims have also been made following radioactive and chemical leaks and instances of noise pollution.

Personal Injury Compensation Claim Advice regarding Toxic Torts

If you or someone you know has been injured or contracted an illness or disease as a direct result of something in the environment, you may wish to contact a lawyer for advice. In the meantime; however, it is important that you retain any evidence you may have which supports your exposure and ensure that when you visit your GP / Hospital for treatment you mention your suspicions about your exposure to doctor. Also remember to retain evidence of any injury-related expenses such as receipts for prescriptions or medication and evidence of travelling expenses.  If you have taken or can take photographs or have documents relating to the hazard, they should be retained as important evidence.

Providing it can be proven that your injury was caused by your exposure to the hazardous substance and the person / company who allowed the substance to pollute the environment was negligent, then your claim for compensation should be valid.

In some toxic tort cases there will be many people who have suffered from injuries in connection with the same incident or exposure. Cases involving a group of people who have been injured by the same hazard are called “Multi-Party claims”.  It could be your own family members, neighbours or friends that are affected.
