Huge Rise in Cyclist Compensation Claims

Recently at Thompsons Solicitors we have seen quite a large increase in the amount of injured cyclists who are approaching us to make compensation claims.

The most common causes of injuries to cyclists are collisions with other road users and dangerous road conditions.

One particularly interesting case we dealt with recently involved a tandem cyclist who was injured by farm waste on the road.

On the day of his accident our client was the front rider on a tandem bicycle and was riding along a country road. As he rounded a sharp bend in the road, the wheels of his bicycle hit a large patch of waste (which was later found to be most likely made up of a combination of silage and mud). Our client was thrown from his bike and suffered nasty injuries to his shoulder and leg.

Our client very sensibly returned to the scene of the accident the following day with a camera and took photographs of the road, showing what a disgraceful and dangerous condition it had been left in. It was clear that the waste had originated from a nearby farm as there was a large silage heap nearby with evidence that the entrance to the farm property had been recently accessed by large vehicles as the ground was all churned up.

Thompsons Solicitors made a personal injury compensation claim against the farmer as he should have prevented the waste from spreading into the road. It was clear from the photographs that large agricultural vehicles were taking debris in and out of the site on their wheels.

In addition, the farmer had made no attempt to clean up the debris afterwards or warn other road users of the danger even though the waste was on a sharp bend.

Cases like this can be difficult to deal with if the origin of the spillage is unknown but in this case it was very clear where the waste had originated from.
