Information about your Conveyancing

You will receive the following information in the first letter from us:

Communication

You will be kept in regular touch with progress. The executive dealing with the matter will write to you at least every two weeks while the transaction is ongoing.

We will use plain English. We should not be using technical jargon without explaining it to you.

Speed of response

Communications from you should be responded to promptly. Specifically this means:

red bullet indicating list itemyou will be informed promptly and in advance of any unusual or unanticipated expenses

Remortgage of property

This is a guide to the work we will undertake on your behalf in connection with the remortgage of a property:

red bullet indicating list itemHaving received your instructions we write for your deeds.
red bullet indicating list itemOn receipt of the deeds, we will review and make appropriate searches (such as to the local authority) and raise enquiries about the property and the contract.
red bullet indicating list itemWe will make enquiries to make sure you do own the property and have "good title" to it.
red bullet indicating list itemAs you are obtaining a new mortgage, we will make sure that instructions have been received and a satisfactory offer is made. We check that any conditions attached to the mortgage offer can be complied with before completion.
red bullet indicating list itemWe make any further enquiries about the ownership of the property before completion.
red bullet indicating list itemWe make all appropriate title searches before completion.
red bullet indicating list itemWe apply to your present mortgage company for a redemption figure in good time before completion. We will give a "report on title" to your building society to satisfy them that your title to the property is sufficient to secure the mortgage.
red bullet indicating list itemAfter completion we make sure that all appropriate registration at H.M. Land Registry is completed.
red bullet indicating list itemFinally, the deeds are sent to the mortgage company and a copy to you.

Purchase of property

This is a guide to the work we will undertake on your behalf in connection with the purchase of a property:

red bullet indicating list itemHaving received your instructions we write to the seller's solicitors requesting a draft contract and papers.
red bullet indicating list itemOn receipt of the papers, we will review and make appropriate searches (such as to the local authority) and raise "enquiries" about the property and the contract.
red bullet indicating list itemWe will make enquiries as to any covenants (obligations) which affect the property. We will want to make sure the seller does own the property and has "good title" to it.
red bullet indicating list itemWe consider the terms of the contract and whether they are fair to you. If they are, we will "exchange contracts" with the seller's solicitors.
red bullet indicating list itemIf you are obtaining a mortgage to assist you with your purchase, we will make sure that instructions have been received and a satisfactory offer is made. We check that any conditions attached to the mortgage offer can be complied with before completion.
red bullet indicating list itemWe make any further enquiries about the seller's ownership of the property before completion.
red bullet indicating list itemWe make all appropriate title searches before completion.
red bullet indicating list itemWe apply to your mortgage company for the mortgage money in good time before completion. We may need to give them a "report on title" to satisfy them that your title to the property is sufficient to secure the mortgage.
red bullet indicating list itemOn the day of completion, which is the day you can move in, we make arrangements for the payment of the purchase price to the seller's solicitors and obtain documents proving titles.
red bullet indicating list itemAfter completion we make sure that all appropriate stamping and registration at H.M. Land Registry is completed.
red bullet indicating list itemFinally, the deeds are sent to the mortgage company or to you as appropriate.
red bullet indicating list itemEven where deeds are sent to a mortgage company, we will also supply copies for your own reference purposes at home.

Sale of property

This is a guide to the work we will undertake on your behalf in connection with the sale of your property:

red bullet indicating list itemHaving received your instructions, we obtain your deeds.
red bullet indicating list itemOn receipt of the deeds we prepare a draft contract which is submitted to your buyer's solicitors to consider.
red bullet indicating list itemWith the draft contract we send evidence that you own the property and details of any obligations, called "covenants" (such as to maintain a common area with a neighbour), to which your property is subject.
red bullet indicating list itemThe buyer's solicitors will raise "enquiries" about the contract and your property. We will need to take your instructions to be able to answer the questions they raise - all matters affecting the property have to be disclosed. We want to avoid your being liable for any mis-representation after the sale has been completed.
red bullet indicating list itemWe will then agree the terms of the contract.
red bullet indicating list itemContracts will be exchanged once you are ready to be committed to the sale and the buyer can be committed to the purchase. Before they do so, the buyer will want to have completed their enquiries and arranged their mortgage or lined up their sale as the case may be.
red bullet indicating list itemAfter exchange of contracts, the final documentation will have to be approved and agreed on your behalf.
red bullet indicating list itemIf appropriate, we will obtain details of any person holding a mortgage over the property so that we can make sure they can be paid off on completion.
red bullet indicating list itemWe will reply to any further enquiries about your ownership of the property raised by the buyer's solicitors.
red bullet indicating list itemWe will make arrangements for completion to ensure that your move goes smoothly on the day.
red bullet indicating list itemOn the day of completion, the day by which you must have moved out, we will receive the money from the buyer's solicitors, pass over the deeds, pay off any mortgage(s) and arrange for their formal discharge. The documentation for this will be sent on to the buyer's solicitors.
red bullet indicating list itemFinally, we will credit to your account money owed to you. If appropriate we will ensure that sufficient money is in hand for your purchase.
red bullet indicating list itemWe will pay any commission out of the net proceeds of sale to any estate agents.
red bullet indicating list itemThroughout the transaction, estate agents will ask us for information about progress and we will deal with them on your behalf.

Complaints Procedure

The firm's complaints policy

As a firm, Thompsons Solicitors is committed to providing a quality legal service to you and to all its clients. Consequently, when something goes wrong or any client believes they have reason to complain, it is essential that we have an effective procedure to assist the complete and early resolution of the problem. Only by doing so can we maintain the quality standards we have set ourselves and improve them by learning from what may have gone wrong and from what our clients tell us.

The procedure

Although it is not essential, in making your complaint, it would be helpful if you could provide details of your concerns in writing (if you have not already done so). Your complaint should be addressed to the Managing Partner at :

Thompsons Solicitors, The New Union House, 2 Harbour Avenue, Plymouth, PL4 0BJ.

While the Managing Partner will retain overall responsibility for the handling of your complaint, some of the steps set out below may be undertaken by someone designated by them to deal with the matter and who will accept initial responsibility for dealing with the complaint.

What will happen next?

red bullet indicating list itemWe will acknowledge receipt of your complaint, set out our understanding of it and request your confirmation or seek any necessary clarification. We will also confirm who will be dealing with your complaint within three days of receipt.
red bullet indicating list itemThe complaint will be registered in the Central Register (for monitoring and management information purposes) and a separate file will be opened.
red bullet indicating list itemWe will acknowledge receipt of your confirmation letter or telephone call and confirm what will happen next and agree a timetable for dealing with your complaint.
red bullet indicating list itemWe will then commence investigating your complaint. This may involve the following steps:
i) the person who acted for you may be asked to provide a response to your complaint
ii) the response will be examined together with the file and your complaint and, if necessary, further information will be sought from the person who acted for you
iii) you may then be invited to meet with the individual handling your complaint to discuss and hopefully resolve your complaint.
red bullet indicating list itemIf you do not wish to attend a meeting or it is for some reason impractical, we will write to you with a detailed response to your complaint and with any suggestions we have for resolving it. If a meeting does take place, we will still write to you to confirm the outcome of the meeting and any agreed solution arrived at.
red bullet indicating list itemIf, at the meeting or from your written reply to our detailed written response, you remain dissatisfied with what we said and how we proposed to resolve your complaint, we will then arrange for our decision to be reviewed.

Review

This will happen in one of the following ways:

red bullet indicating list itemthe person dealing with your complaint will review their own handling of your complaint and why you are dissatisfied with the decision,
OR
red bullet indicating list itemanother Partner will consider all relevant information, how the complaint was handled and the decision made.

NOTE: The time scale for conducting the review process above will be notified to you within seven days of receipt of your request for a review. You should receive notification of the outcome of the review within 14 days of this acknowledgement.

red bullet indicating list itemThe outcome of the review will assess our initial handling of your complaint and our decision upon it.
red bullet indicating list item If you remain dissatisfied with how your complaint has been handled we will supply you with the name and address of The Law Society's Consumer Complaints Service, which is the solicitor's regulatory body to whom you may refer your complaint once we have concluded our professional obligation to try and resolve it.
