If the accident was in a building open to the public such as a bank, a supermarket, a theme park or a restaurant then the personal injury compensation claim would be settled by the occupier’s public liability insurance policy providing the accident was the occupiers fault.

If your accident was on a council owned property such as a public pavement, a school or a council house rented out to a member of the public, then you would be able to make a personal injury compensation claim against the local authority if the accident was due to their negligence. It may also be possible to claim in Public Nuisance for accidents in public places.  For example, you would be able to make a claim if a roof tile fell from the council house and injured you; however, you would not be able to make a claim against the local authority if you tripped on an item left lying around in the property by the tenant unless you could show that the council itself was in some way at fault. You could, of course claim against the tenant in that situation but this may not be viable unless the tenant has relevant insurance cover or the financial means to pay any damages and costs personally.

If your accident was on private property such as a house or piece of land privately owned by an individual, you would be able to make a personal injury compensation claim providing the accident was the fault of the land owner or occupier and they had suitable insurance in force or again the personal financial means to pay.

To make a successful personal injury compensation claim, you would need to prove that another person was responsible for your personal injury (in this case, the owner of the property where your accident happened).

To help your case, you should report the accident to the staff or owner at the time, make a note of your accident in the accident book if possible, take names and addresses of witnesses to the accident and if possible take photographs of the area where the accident happened.

If you are intending to claim expenses such as prescription costs and travelling expenses, remember to keep receipts as evidence.
