Introduction to Fatal Injury Claims
Claim on behalf of a deceased relative
It is an unfortunate fact that people do die in accidents and leave behind devastated family members and loved ones. If the fatal accident was someone else's fault, then the family of the deceased may be able to make a fatal injury compensation claim.
Making a claim for compensation will obviously not be the first thing those loved ones think of but in some cases the compensation will be essential for the family to carry on after the death.
For example, if a man is killed in an accident at work, leaving behind his wife who looks after their children, she may have no way of providing for those children in his absence.
Because fatal accident compensation claims are so important for the family left behind, you need a firm of solicitors with experience of dealing with complicated and high value claims as well as a firm which can act with compassion and empathy towards the deceased's family.

Types of Fatal Injury Compensation Claims we have dealt with
Examples of Fatal Injury Claims Thompsons have handled
Every bereaved family member we speak to when helping them with their fatal accident claims tells us that the compensation they receive will never make up for the loss of their loved one; however, it will help them achieve some sort of justice for them.
Below are a few examples of fatal injury compensation claims we have dealt with:
Brian Pemberton
Brian was only 42 years old when he was killed at work after being electrocuted. His widow made a fatal injuries compensation claim on his behalf with the help of the Trade Union he belonged to and Thompsons Solicitors.
Brian had received no electrical training from his employers and was investigating a water seepage coming from an oven when was electrocuted and died.
Brian's widow, Joyce Pemberton said: "All I ever wanted was for Brian's employers to admit it was 100% their fault. They were fined a small sum by the magistrates but neither that trial or the inquest found anyone accountable. In my opinion people who have had their loved ones killed in this way should automatically have their cases heard in the County Court. I wasn't interested in the money but I was determined not to settle this case until we had a confession."
Frederick Moses
Frederick Moses was 62 years old when he died in Hospital after suffering multiple injuries from a fall at work.
He worked in a warehouse and fell approximately 15 feet through a large hole in the floor. His daughter made the fatal accident compensation claim on his behalf with help from Thompsons Solicitors.
Mr Moses’ daughter, Gail who lives in Ormskirk, Lancashire, said "I've got a great many questions about what happened that day, but I particularly want to know why my father was working where there was such a big opening in the floor. I want to know what his employers had done to prevent anyone falling through it."
Daniel Dennis
Daniel was only 17 years old when he died. It was his first week of work when he was sent up onto a roof with no training in working at heights, no training in roofing and no safety equipment. He fell 28 feet through a skylight and died later that day in hospital.
His family made a claim for compensation against his employers with help from their Trade Union and Thompsons Solicitors. They have also campaigned with Thompsons and the Trade Unions to have a Corporate Manslaughter Bill brought in by the Government.
Daniel’s father, Peter Dennis said: "Sadly nothing can bring back my son, but if this succeeds in preventing another tragic death at work it will be well worthwhile."
Making a Personal Injury Compensation Claim for a Deceased
Advice from a Specialist Personal Injury Solicitor
As with all personal injury compensation claims, you would need to prove that the fatal accident was caused as a result of the negligence of another party and once you appoint a personal injury compensation solicitor, they will assist you in compiling the evidence and presenting it to the third party insurers.
Every personal injury compensation claim is very different and while some are settled within a matter of months, others can take years. Most cases are settled out of Court; however, some will need to progress this far.
Personal injury compensation awarded to a family on behalf of a deceased relative can include an amount for the pain and suffering of the deceased, repayment of actual losses such as funeral expenses and a bereavement award for the deceased’s spouse or parents. Cohabitees in a long term unmarried relationship such as common law husbands and wives that have lived together continuously for more than 2 years prior to the date of death are essentially treated the same as married partners and can claim. Equally, partners in a Civil Partnership or any individual that has a financial dependency on the person killed may be able to claim compensation too. This can include grandchildren if they are being cared for on a permanent basis by a grandparent that is killed, dependent or elderly parents or persons with a disability in a similar dependent position.
