The Working Time Regulations 1998

Rules and Regulations to protect Professional Drivers

The Working Time Regulations are in place to protect all workers but there is a section which specifically mentions professional drivers and their working hours which are designed to protect the professional driver, any passengers they may have and other road users.

The regulations specify that breaks should be taken from driving at regular intervals and limits are put on the amount of time a professional driver can spend behind the wheel each day.

The regulations are complex but generally after driving for 4.5 hours a driver must take a break of at least 45 minutes.  The maximum daily driving time is 9 hours.

Highways driver compensated for faulty brakes - In this case, our client was a van driver who had noticed some problems with the brakes on his van.  He had asked his employer to check the brakes three times before his accident and each time he had been told that they were fine.  On the day of his accident, the brakes seized up and he collided with another vehicle.

Compensation quadrupled for GMB member - Our client in this case was a lady who was driving a company van when a driver travelling in the opposite direction lost control of their car and collided with her van.  The other driver's insurance company contacted her and tried to offer her £800 to settle the claim with them direct.  She contacted Thompsons Solicitors instead and we recovered £3,500 compensation for her which was a fair payment for the injuries she sustained.

Compensation for driver with crushed foot - Our client in this case was a coach driver whose foot was crushed in an accident at work.  He was performing user checks on a coach at the beginning of his shift in March 2010 and, as he opened the bus’ hanger door, it fell from its hinges and landed on his right foot.  He suffered severe crush injuries and nerve damage in the accident and was left with a loss of feeling in his foot and a residual scar.
