Introduction to Injury Claims for Shop Workers
Injured at work in a shop or supermarket?
Jobs in the retail sector can vary tremendously from nightshift workers replenishing stocks to personal shoppers, checkout operators and greeters at the front of a supermarket.
In just the same way that a customer injured in a shop can make a personal injury compensation claim if the accident was caused by the negligence of the store, a member of staff working in a shop can also make a claim for compensation if they are injured due to their employer's negligence. Workers can also make a personal injury claim for compensation if their injury was caused by a colleague.

Common Injuries suffered by Shop Workers
Accidents sustained by Shop Workers and Supermarket Staff
Below you will find information about some of the most common types of injury claim we deal with at Thompsons Solicitors for injured shop workers. If your type of accident or injury is not mentioned below, please call us to discuss your individual circumstances and we will let you know if we can help you with no obligation to instruct us.
Slips, Trips and Falls
In a busy retail environment, it is essential to have a system in place where the floor is regularly inspected and hazards removed. In a supermarket or shop with hard-flooring, it is a common occurrence for spillages or breakages to occur or for litter to be dropped on the floor. Hazards of this nature should be removed as soon as possible and warning signs displayed until the floor is completely dry and safe. In clothing shops, items for sale or hangers may be knocked onto the floor and become tripping hazards which is why frequent inspection is so important. Corridors and stockrooms including staff-only areas should be kept clean and clutter free from boxes etc to avoid tripping accidents. Slips, trips and falls can result in a wide range of different injuries including lacerations, broken bones and head injuries.
Injured by Falling Objects
If goods are not stacked properly, there is a risk that they could fall and hit someone. If someone else has badly stacked goods which have fallen and injured you, you may be able to make a claim for compensation. This could have happened in a stock room, out on the shop floor, or whilst unloading a delivery van for example. Head injuries are common from this type of accident.
Lifting Heavy Objects
As far as is possible, lifting heavy objects should be avoided in work and employers should provide equipment to minimise the amount of lifting involved. Where lifting cannot be avoided, the members of staff should be provided with training on how to lift heavy objects correctly and safely. Common injuries caused by lifting heavy objects such as stock are back injuries, arm injuries and foot injuries.
Defective Equipment and Dangerous Machinery
At Thompsons Solicitors we have dealt with a number of claims for injured shop workers which have been caused by defective equipment or dangerous machinery. For example a cage (or "comp" as they are sometimes known) which is being pulled along, filled with goods but which has a faulty wheel can cause injuries if it suddenly stops dead or tips over. We can also help with cases where injuries have been caused by machinery such as meat slicers which should have had a guard or where the worker had not received proper training on how to operate it.
Injuries caused by colleagues
Employers can often be held responsible for the actions of their staff and if you are injured by a colleague you may be able to make a personal injury claim for compensation against your employer. The injury could be caused by a deliberate act such as an assault at work or by a prank which went wrong and resulted in an injury. It could also be caused by negligence such as a colleague pushing a cage into you, driving a fork lift truck into you or dropping a heavy object on your foot etc.

Shop worker compensated after fall in listed building
In this case our client was a shop worker employed by Past Times. The company changed premises into a new building and the staff made complaints that the spiral staircase in the listed building was in a dangerous condition. No action was taken before our client fell down the staircase suffering back and hip injuries.
She was absent from work because of her injury for two months and had to have physiotherapy carried out. Following her accident, her employer fitted rubber grips to the stairs to prevent a similar accident.
Thompsons Solicitors recovered £5,000 compensation for her and she said “My life has changed dramatically since the accident. I used to ride my neighbour’s horse every day but my injuries mean I can no longer ride and I cannot drive for longer than half an hour. I am still in pain but I try hard not to give into it and I am determined to keep working as long as I can.”

Brave pensioner injured by hooded robbers
Our client in this case was a lady employed as a night time forecourt cashier at a motorway services. She was at work one night when she became the victim of an assault by a group of youths trying to rob the service station shop.
It was foreseeable that the service station would be a target for thieves and her employer should have put procedures in place to make sure its employees were safe in the event of a holdup.
The lady injured her knee in the assault and needed a steroid injection and physiotherapy. She was unfortunately medically retired after the assault and now suffers from arthritis.
Thompsons Solicitors recovered £36,000 for the woman which took into account her lost earnings and the fact that she needed help around the house after the assault.

Student receives compensation after losing his leg
In this case, our client was a university student who had taken a sales job during the holidays. The young man was at work when a colleague who was not trained to drive a fork lift truck but who was doing so anyway, collided with him and pinned him against a gas tank.
Surgery was attempted but was unsuccessful and his leg was amputated below the knee. Thompsons Solicitors recovered a substantial sum in compensation for the injured student and he said “The last 18 months have been a nightmare. I never imagined that an accident like this could happen to me. Dealing with my injuries was difficult at first but I’ve learnt that you have to just pick yourself up and get on with things. It is good to be back at university now. I get tired very easily and I still have phantom pains in my leg, but I am determined to finish my degree regardless of my injuries. I am looking forward to being able to use my new prosthesis which this compensation will allow me to buy.”
