Successful Personal Injury Claims
Below, you will find just a few examples of personal injury compensation claims Paul has dealt with in the Newcastle office.
Car Accident results in permanent pain
Paul's client in this case was a lady who was injured after her car was hit in the rear at speed while she was stationary at traffic lights.
After the accident she developed pain in her neck and an overwhelming feeling of nausea. Her injuries became so bad that she was forced to take time off work sick and eventually had to retire on the grounds of ill health. The chronic neck pain and nausea mean she cannot sit or stand for long periods of time and on occasions can be so bad that she cannot leave the house. She has been told that she is likely to suffer from pain and nausea for the rest of her life.
Paul recovered £309,500 in compensation for the lady who transferred her case to Thompsons which took into account her lost earnings from the job she loved which she had to give up.
Accident at work results in amputation
In this case, Paul's client was a man called Ian Slowther who was injured in an accident at work. During the course of his work, he had to cross a conveyor belt and it was normal practice in the workplace to stand on the conveyor belt to do this.
On the day of Ian's accident, he was standing on the conveyor belt when a colleague started the belt and Ian's leg was dragged between the rollers. His lower leg had to be amputated below the knee due to the severity of the injury. Paul recovered over £700,000 compensation for his client which helped with the cost of changes he had to make in his life.
As part of the claim a private case manager was recruited who assisted with ongoing rehabilitation and care. Three private high quality prosthetic limbs were purchased with the total amount of £108,000 in interim payments being made during the course of the case. The interim payments also allowed the client to access private physiotherapy and psychology treatment when required and obtain aids and equipment which were assessed by an Occupational Therapist. The client's accommodation was also assessed and the award of compensation included an amount for the adaptation of the current property or purchase of a more suitable property so that the client’s lifelong needs are met. The award also included an amount to ensure that the client had access to private care for the remainder of his life so that in later years when his amputation meant that he would require additional care he could source that privately if required.
Factory worker compensated after crush injury
Paul's client in this case was a factory worker called Darrell Neromilotis from Barrow in Furness. He was at work using a pipe bending machine to bend stainless steel when the machine started to shake and move around because the pipe was too thick for the equipment. His left hand was dragged into the machine and because the emergency stop device was faulty, Darrell’s hand was trapped until a colleague could help him.
The fault on the emergency device had been identified months earlier but nothing had been done to fix it. Darrell was forced to take five months off work after the accident whilst he underwent two operations to mend his hand and wrist. He was left with a permanent disability to his wrist and hand causing reduced movement and loss of strength.
Paul was successful in recovering compensation for his client as his employer should not have kept the machine in use after the fault was identified.
Cycling Accident leads to amputation of leg
In this case, Paul's client was a man who was hit from behind by a car whilst cycling. He was thrown up onto the car bonnet suffering head injuries as well as having his right leg broken in five places. He required five operations straight after the accident and a further nine in the eighteen months afterwards. Eventually surgeons conceded defeat in saving his leg and decided to amputate below the knee.
Paul made a claim for compensation against the car driver's insurance policy and recovered a total of £750,000 for the injured cyclist which included interim payments totalling £123,000 during the course of the case in order to ensure that not only loss of earnings but private therapies, aids and equipment and private prosthetic limbs were paid for in advance. The final settlement included provision for a specially adapted bungalow, ongoing rehabilitation and other therapies, replacement prosthetic limbs, and aids and equipment.
