Introduction to Assaults at Work
About Assaults in the Workplace
Whilst at work, we all expect and deserve to be kept safe from dangers and hazards and to return home each day unharmed.
The law imposes duties on employers to protect their workers from injury and this includes not only accidents at work but also, in certain circumstances deliberate acts of violence such as an attack or assault in the workplace.
If you have been attacked at work or assaulted at work, you may be entitled to make a personal injury compensation claim. To discuss your case with no obligation, call us on 08000 224 224 or complete one of our online personal injury compensation claim forms.
Who would pay Assault at Work Compensation?
Who settles Assault at Work Compensation Claim?
If you have been exposed to an unnecessary and foreseeable risk of personal injury by your employer or they failed to protect you properly, which led to the assault or attack, then you may be able to hold your employer responsible and make a claim for compensation against your employer's insurance policy.
In cases like this, the personal injury claim is made in a similar way to other workplace accident claims which Thompsons Solicitors have a wealth of experience in dealing with.
If the assault was not your employer's fault in any way or if you have been assaulted outside of work, you should visit our CICA (Criminal Injuries Compensation Authority) page for more advice.
To discuss any type of personal injury claim you are thinking of making, you can reach us on 08000 224 224 or via one of our online personal injury compensation claim forms.
When can an employer be held responsible for an attack or assault?
Is my employer responsible for Assault at Work?
There are many different circumstances where an employer might be held responsible for one of their employees suffering an injury from an assault or attack. A few of the most common are shown below as examples.
Working alone or understaffed
Members of staff who are left to work alone or in a short-staffed environment can be particularly vulnerable to attacks or assaults. Security guards, prison officers and carers for people with challenging behaviour can be at particular risk from this kind of situation.
Ignoring previous violent behaviour
If an employer is aware that a certain person (another member of staff, patient or client) has committed violent acts in the past (or could have easily found out) but takes no action and that person assaults a member of staff, then the employer may be able to be held liable. Similarly if a place of work has been subject to a series of robberies in the past but no extra security measures are taken and a member of staff is injured in a subsequent robbery then the employer may be held responsible.
Lack of Training or PPE (Personal Protective Equipment)
When working in a profession where you are likely to encounter angry, violent or difficult clients or customers, it is important that you receive training on how to diffuse potentially dangerous situations. As a last resort, PPE should be provided to try and prevent or limit the seriousness of the injury. It is important that all safety equipment such as panic alarms etc are in full working order.
If you have been injured after an assault at work you may be able to make a personal injury claim for compensation. To discuss your case with no obligation, call us on 08000 224 224 or complete one of our online personal injury compensation claim forms.
