How to start a claim for asbestos compensation
Asbestos is the name given to a group of naturally occurring minerals which were manufactured into insulation materials frequently used in power stations, construction, shipbuilding and various other industries. Asbestos products were used widely throughout most of the last century because it was non-flammable, flexible, virtually indestructible and low heat-conducting. It was perfect for use as insulation, brake linings, cement and fire-proofing.
Although asbestos was very useful, it was also known to cause lung disease. Asbestos is made up of microscopic fibres which can be inhaled into the lungs. Diseases caused by inhaling asbestos fibres can take between 15 to 50 years or more to occur.
There are different types of asbestos related conditions and they each vary in severity. The conditions include pleural plaques, pleural thickening, mesothelioma, lung cancer and asbestosis. Regardless of which of these conditions you have contracted (with the exception of pleural plaques), if it can be proven that you were exposed to the asbestos negligently then you may be able to make a personal injury claim for compensation.
Pleural plaques are a form of scarring of the outer lining of the lung. Although pleural plaques do not normally cause any symptoms they are an indication of previous exposure to asbestos.
People diagnosed with Pleural plaques, often become anxious about whether they will develop a fatal asbestos related illness in the future, such as mesothelioma.
In the past it was possible for people suffering from pleural plaques to recover compensation. A recent test case in the House of Lords decided that compensation can no longer be awarded for pleural plaques. However, if you have been diagnosed with pleural plaques or any other form of asbestos related disease you should still contact Thompsons Solicitors for free expert legal advice.
Thompsons Solicitors were involved in fighting the test cases to retain the right to compensation for pleural plaques sufferers. Since the House of Lords decision Thompsons Solicitors has been supporting the Trade Union led campaign to restore the right to compensation for pleural plaques
